TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

These Terms of Service ("Terms") constitute a legally binding agreement between you and Premiumtex Korlátolt Felelősségű Társaság ("Company," "we," "us," or "our"), a Hungarian limited liability company with its registered office at 6792 Zsombo, Dozsa dulo 55, Hungary, regarding your use of the UNCOVERED mobile application (the "App").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. AGE REQUIREMENT AND ELIGIBILITY

YOU MUST BE AT LEAST 18 YEARS OF AGE TO USE THIS APP.

By using the App, you represent and warrant that:

  • You are at least 18 years of age
  • You have the legal capacity to enter into these Terms
  • You will comply with all applicable local, state, national, and international laws and regulations

The App contains content related to alcoholic beverages and is intended for adults of legal drinking age. We reserve the right to verify your age and terminate your access if you do not meet the age requirement.

3. DESCRIPTION OF SERVICE

UNCOVERED is a multiplayer party game application designed for entertainment purposes. The App allows users to:

  • Create and join game rooms
  • Participate in question-based party games
  • Upload optional profile avatars
  • Access different game categories based on subscription tier
  • Interact with other players in real-time

4. USER ACCOUNTS AND REGISTRATION

4.1 Anonymous Authentication

The App uses Firebase anonymous authentication. No personal registration is required, but you are responsible for all activities that occur under your session.

4.2 User Conduct

You agree NOT to:

  • Use the App for any illegal purpose
  • Harass, abuse, or harm other users
  • Upload inappropriate, offensive, or illegal content
  • Attempt to circumvent any security measures
  • Reverse engineer or decompile the App
  • Use automated systems (bots) to access the App
  • Violate any applicable laws or regulations

5. USER-GENERATED CONTENT

5.1 Avatar Images

Users may optionally upload profile avatar images. By uploading an avatar, you represent and warrant that:

  • You own the rights to the image or have permission to use it
  • The image does NOT contain:
    • Nudity or sexual content
    • Hate speech, violence, or discriminatory content
    • Illegal content or copyrighted material
    • Personal information of minors
    • Any content that violates these Terms

5.2 Content Storage and Deletion

  • Avatar images are stored temporarily for the duration of the game session
  • All avatar images are AUTOMATICALLY DELETED when the game room is closed
  • Images are stored on servers located in the United States
  • We employ manual moderation and reserve the right to remove inappropriate content

5.3 Content Ownership and License

You retain ownership of any content you upload. By uploading content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, and display the content solely for the purpose of providing the App's services.

5.4 Content Removal and Legal Action

We reserve the right to:

  • Remove any content that violates these Terms
  • Terminate accounts that repeatedly violate content policies
  • Report illegal content to appropriate law enforcement authorities
  • Pursue legal action against users who upload illegal or harmful content

6. INTELLECTUAL PROPERTY

6.1 Ownership

All content within the App, including but not limited to:

  • Game questions and prompts
  • Design, graphics, and user interface
  • Software code and algorithms
  • Trademarks and logos

are the exclusive property of Premiumtex Korlátolt Felelősségű Társaság or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial entertainment purposes in accordance with these Terms.

7. SUBSCRIPTIONS AND PAYMENTS

7.1 Subscription Tiers

The App offers the following subscription tiers:

  • Free: Limited categories, ads displayed
  • Premium: Additional categories, ad-free experience
  • Ultimate: All categories unlocked, ad-free experience

7.2 Payment Terms

  • Subscriptions are processed through Apple's App Store
  • All payments are subject to Apple's standard payment terms and policies
  • Prices are displayed in your local currency and may vary by region
  • Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period

7.3 Cancellation and Refunds

  • You may cancel your subscription at any time through your Apple App Store account settings
  • Refunds are handled in accordance with Apple's standard refund policy
  • No refunds will be provided for partial subscription periods
  • Upon cancellation, you will retain access until the end of the current billing period

7.4 Price Changes

We reserve the right to change subscription prices at any time. Price changes will not affect existing subscribers until their next renewal period.

8. THIRD-PARTY SERVICES

8.1 Advertising

The App displays advertisements provided by Google AdMob (free tier only). We are not responsible for the content of third-party advertisements. Your interaction with advertisements is governed by the advertiser's terms and privacy policy.

8.2 Firebase Services

The App uses Google Firebase services for:

  • User authentication
  • Real-time database (hosted in EU)
  • Cloud storage (hosted in USA)
  • Analytics

Your use of these services is subject to Google's Terms of Service and Privacy Policy.

9. ALCOHOL-RELATED DISCLAIMER

IMPORTANT: This App is designed as a party game that may involve alcohol consumption.

9.1 Responsible Use

By using the App, you acknowledge and agree that:

  • You are solely responsible for your alcohol consumption and behavior
  • We strongly encourage responsible drinking and adherence to local drinking laws
  • We do NOT encourage excessive drinking, drunk driving, or harmful behavior
  • The App is intended for entertainment purposes only

9.2 Health and Safety

You should NOT use this App if:

  • You are under the legal drinking age in your jurisdiction
  • You are pregnant or nursing
  • You have medical conditions that prohibit alcohol consumption
  • You are taking medications that interact with alcohol
  • You are operating vehicles or machinery

9.3 Legal Compliance

You are responsible for complying with all applicable laws regarding alcohol consumption in your jurisdiction, including:

  • Minimum drinking age requirements
  • Public intoxication laws
  • Drunk driving laws
  • Any other relevant regulations

10. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

10.1 No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

10.2 Limitation of Damages

IN NO EVENT SHALL PREMIUMTEX KORLÁTOLT FELELŐSSÉGŰ TÁRSASÁG, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, revenue, data, or use
  • Personal injury or property damage
  • Damages arising from alcohol consumption or intoxication
  • Damages arising from user-generated content
  • Damages arising from third-party services or advertisements

ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

10.3 Maximum Liability

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED US DOLLARS ($100), WHICHEVER IS GREATER.

10.4 Essential Purpose

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

11. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Premiumtex Korlátolt Felelősségű Társaság, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

  • Your use or misuse of the App
  • Your violation of these Terms
  • Your violation of any rights of another party
  • Your uploaded content
  • Your alcohol consumption or behavior while using the App

12. TERMINATION

12.1 Termination by You

You may stop using the App at any time by deleting it from your device.

12.2 Termination by Us

We reserve the right to suspend or terminate your access to the App at any time, without notice, for:

  • Violation of these Terms
  • Illegal activity
  • Abusive behavior toward other users
  • Uploading inappropriate content
  • Any other reason at our sole discretion

12.3 Effect of Termination

Upon termination:

  • Your right to use the App immediately ceases
  • All data associated with your session will be deleted
  • Subscription refunds will be handled according to Section 7.3

13. PRIVACY AND DATA PROTECTION

Your use of the App is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand how we collect, use, and protect your information.

14. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

  • Posting the updated Terms in the App
  • Updating the "Last Updated" date at the top of this document
  • Sending a notification through the App (if applicable)

Your continued use of the App after changes constitute acceptance of the modified Terms. If you do not agree to the changes, you must stop using the App.

15. MODIFICATIONS TO THE APP

We reserve the right to:

  • Modify, suspend, or discontinue any aspect of the App at any time
  • Change or remove content, features, or functionality
  • Impose limits on certain features or restrict access to parts of the App

without liability to you.

16. GOVERNING LAW AND DISPUTE RESOLUTION

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law provisions.

16.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Hungary.

16.3 Dispute Resolution

Before filing any legal action, you agree to attempt to resolve disputes informally by contacting us at perjesidev@gmail.com. We will attempt to resolve the dispute within 30 days.

17. SEVERABILITY

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

18. ENTIRE AGREEMENT

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Premiumtex Korlátolt Felelősségű Társaság regarding the App and supersede any prior agreements.

19. NO WAIVER

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

20. ASSIGNMENT

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

21. FORCE MAJEURE

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, or failures of third-party services.
